Aggravated Driving Under the Influence of Alcohol/Other Drugs

Under Section 11-501 of the Illinois Statutes, it's unlawful for a person to drive or be in actual physical control of a vehicle with a blood alcohol concentration of .08% or more or while under the influence of an intoxicating compound or combination thereof.

Under Section 11-501(d), Aggravated driving under the influence of alcohol or other drugs, or intoxicating compounds or any combination thereof, a person will be charged with aggravated DUI if when in violation of this section, was involved in a motor vehicle accident that resulted in great bodily harm, permanent disability or disfigurement to another.

A person convicted of aggravated driving under the influence of alcohol, drugs, or intoxicating compounds, or any combination thereof is guilty of a Class 4 felony and shall be sentenced to a term of imprisonment ranging from 1 to 12 years and up to a $25,000 fine.

If as a result of driving under the influence of alcohol the defendant was involved in a motor vehicle accident which resulted in death of another person, it shall be charged as a Class 2 felony, which can result in up to 14 years imprisonment, or up to 28 years imprisonment if the violation resulted in the death of two or more persons.
